Frequently Asked Questions

An uncontested divorce is the way to go. First and foremost, it minimizes the emotional toll that divorce can take on a couple. When you can sit down together, with attorneys at your side, and find solutions, you can end the divorce on a positive note. But also, practically speaking, an uncontested divorce means less money spent on legal fees, accounting fees, and court costs. It also means less time negotiating and interacting with your former spouse when you could be moving on with your life. The major drawback of an uncontested divorce comes when you do the divorce on your own. This typically happens when there are minimal assets and no children. It also happens when one side uses a history of physical, emotional, and financial abuse to manipulate the situation and persuade you to agree to an unfavorable divorce agreement. In either case, you should know that retaining an uncontested divorce attorney to review the agreement is always in your best interests to ensure it is fair – you do not want to wake up the day after a divorce decree is issued and regret it.
In order to obtain the benefits of an uncontested divorce to dissolve your marriage, you must meet certain requirements. The first set of requirements refer to residency and grounds for divorce. Pursuant to A.R.S. §§ 25-312, 25-1002, 25-1031, you or your spouse must have lived in Arizona (or, if in the military, be stationed here) for at least 90 days prior to filing the initial divorce papers unless you have children, in which case you must have lived in Arizona for six months before filing the papers (or, if the child is younger than six months, since birth). You must also agree that the marriage is irretrievably broken, meaning you cannot reconcile your relationship. Then, the second set of requirements refer to your mutual agreement on all provisions in the divorce agreement. Pursuant to A.R.S. §§ 25-316, 25-317, you must agree on the division of property and debts, spousal maintenance (if applicable), and parenting time and child support (if you have children together). If you cannot agree on one of these provisions, it will have to be settled at trial by a judge or jury.
